These Terms of Service govern your relationship with Datheon and outline the rules, rights, and obligations that apply when you use our website or engage our services. Please read them carefully before proceeding.
Acceptance of Terms
By accessing or using Datheon's website (datheon.in) or engaging our services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services.
Datheon reserves the right to update these terms at any time. Continued use of our services after changes constitutes acceptance of the revised terms.
Services
Datheon provides AI systems design, automation development, voice agent deployment, and related consulting services. Specific deliverables, timelines, and fees are agreed upon in individual project contracts or statements of work.
Our SaaS products — Flowlyzer and Litlyzer — are governed by their own separate terms of service available on their respective websites.
Intellectual Property
All code, designs, documentation, and other deliverables created by Datheon for a client project become the property of the client upon full payment, unless otherwise specified in the project agreement.
Datheon retains the right to reference the project in its portfolio and marketing materials unless the client requests confidentiality in writing.
Confidentiality
Datheon treats all client information, business data, and project details as confidential. We do not share client information with third parties without explicit consent, except as required to deliver the services (e.g., cloud hosting providers).
Clients are expected to keep any proprietary methodologies, pricing, or internal systems developed by Datheon confidential unless publicly disclosed.
Payment Terms
Project fees are outlined in the individual project agreement. Standard payment terms require an upfront deposit before work begins, with the remaining balance due upon project completion or at agreed milestones.
Datheon reserves the right to pause work on any project with outstanding invoices beyond 14 days overdue.
Limitation of Liability
Datheon's liability for any claim arising out of or related to our services is limited to the fees paid by the client for the specific project in question.
Datheon is not liable for indirect, incidental, or consequential damages, including lost revenue, lost data, or business interruption, even if Datheon has been advised of the possibility of such damages.
Governing Law
These terms are governed by the laws of India. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts in India.
